Subject with a Gun

Incident #23-13904

On November 30^th, 2023 at approximately 10:48 AM, Batavia Police Officers were dispatched to the area of Randall Road and W. Wilson Street for a report of a subject with a gun.

The Batavia Police Department was advised there was a subject in a gray Honda SUV brandishing what appeared to be a black handgun towards another vehicle. The offender was last seen driving away from the area eastbound on W. Wilson Street. Officers responded to the area and conducted a thorough search but were unable to locate the offender or vehicle.

The Batavia High School and H.C. Storm Elementary School were placed in a “secure” status due to the subject’s proximity to the schools and the reported direction of travel of the vehicle. In consulting with BPS 101 on what a secure status is, in summary: the school secured the school perimeter (doors and windows) to minimize exposure to a safety threat outside, such as criminal activity in the area. No person (parent, student, staff member, guest, etc.) may enter or leave the building, but classes proceed as usual. Once the police department confirmed that the threat had passed, the secure status was ended and normal school business resumed.

At no time was there a known direct threat to either school.

The Batavia Police Department always encourages residents who see something they find suspicious to call 911 immediately. Batavia Police welcomes the opportunity to investigate such calls to confirm or disprove a possible threat.

Fox & Turkey Run Traffic Advisory

The 2023 Fox & Turkey Run will take place on Thanksgiving morning, Thursday, November 23rd. There will be several temporary roadblocks and traffic interruptions throughout the Northwest side of the City of Batavia, including the intersections of Route 31 at Houston Street, McKee Street at N. Van Nortwick Avenue, North Avenue at N. Van Nortwick Avenue, and North Avenue at Blackhawk Drive. There will be a full road closure on Houston Street between N. Island Avenue and Route 31. The run officially begins at 7:30 A.M. and will end at approximately 10:00 A.M. The event includes a kids one mile run event followed by a four-mile family run. To the extent possible, this is an “open road” event whereby event participants share the roadway with the motoring public. All participants have been made aware that this is an “open road” event and have been instructed accordingly by the event organizer.

Motorists should use caution and be prepared to encounter increased pedestrian traffic on the following streets during the hours of 6:30 AM - 10:00 AM; (Route 31, Houston Street, N. Island Avenue, N. Van Nortwick Avenue, North Avenue, and McKee Street). Each of the roadway intersections will be staffed by public safety employees and race volunteers. Vehicular traffic will be permitted to pass whenever it is safe to do so. The event will begin and end at the Batavia Riverwalk near the Municipal Center.

Batavia Police Department Participating in DEA Take Back Prescription Drugs Day

The National Prescription Drug Take Back Day addresses a crucial public safety and public health issue. According to the 2021 National Survey on Drug Use and Health, the second most common type of illicit drug use in the past year was the misuse of prescription pain relievers, which were misused by 8.7 million people. Studies show that most abused prescription drugs that were obtained from family and friends, often from the home medicine cabinet. The DEA’s Take Back Day events provide an opportunity for Americans to prevent drug addiction and overdose deaths.

Batavia Bat Fest Traffic Advisory

The Batavia Main Street Bat Fest event will take place on Saturday, October 28, 2023, from 10:00 AM until 2:00 PM. There will be temporary roadblocks and traffic interruptions throughout the downtown area. This includes a 20-minute closure at 10:15 AM for a parade on W. Wilson Street between N. Island Avenue and Water Street. Additionally, Houston Street will be closed between N. Island Avenue and Route 31 for the duration of the event.

Motorists should use caution and be prepared to slow down or stop due to increased pedestrian traffic throughout the downtown area. Motorists wishing to travel east / west through Batavia are encouraged to use alternative routes such as Fabyan Parkway to the north and Route 56 to the south. Please allow extra time on Saturday morning to arrive safely at your destination.

Batavia Police and other community partners will be on-site to assist in providing public safety services for this event.

Arrest Made in Cruelty to Animals Case

On Friday, August 4, 2023, at approximately 11:22 AM, Batavia Police were dispatched to a business in the 900 block of W. Wilson Street reference the report of a deceased cat in unusual circumstances. The complainant, a representative of the business, had discovered a deceased cat in a box in the business’s dumpster. The complainant reviewed the business’s video surveillance footage which showed an individual running over the cat several times with a motor vehicle, then placing the cat into the dumpster. The video indicated the event occurred on Thursday, August 3, 2023, at approximately 11:45 PM.

A thorough investigation was conducted, which included checking the cat for a microchip, which provided the name of the cat’s owner. A family member of the deceased cat’s owner was subsequently identified as the individual that had run over the cat and placed it into the dumpster. In consultation with the Kane County State’s Attorney’s Office, the defendant was charged with multiple criminal offenses and an arrest warrant was obtained.

Animal Torture - 510 ILCS 70/3.03(a) – Class 3 Felony

Aggravated Cruelty to Animals – 510 ILCS 70/3.02(a) – Class 4 Felony

Violation of Animal Owner’s Duties/First Offense - 510 ILCS /70.3 – Class B Misdemeanor (2 counts)

Loeffler turned himself in to Batavia Police on Saturday, September 2, 2023. He was processed and subsequently transported to the Kane County Jail for Bond Court.

The charges against Loeffler are not proof of guilt. Loeffler is presumed innocent and is entitled to a fair trial in which it is the State’s burden to prove guilt beyond a reasonable doubt.

Suspect Charged in Burglary at Funway

Case # 23-9392

On Thursday, August 10, 2023 at approximately 7:03 AM, Batavia Police Officers were dispatched to the Funway Family Entertainment Center located at 1335 S. River Street for a reported burglary in progress. Officers arrived on scene and subsequently made contact with the suspect and took him into custody without incident.

It is believed the suspect had previously burglarized the business numerous other times since mid-July and committed thefts to vending machines. There is no indication that the suspect made forced entry into the business. It is believed he entered the building through an unsecured door before normal business hours while cleaning crews were in the building. After consulting with the Kane County State’s Attorney’s Office, the defendant was subsequently charged with multiple criminal offenses.

Christopher M. Covelli, 30, of the 100 block of Dee Road in North Aurora, IL.

Charges:

Burglary 720 ILCS 5/19-1(a) – Class 2 Felony (7 counts)

Possession of Burglary Tools – 720 ILCS 5/19-2(a) – Class 4 Felony

Theft 720 ILCS 5/16-1(a)(1)(a) – Class A Misdemeanor

Residential Burglary

Monday, July 17 2023

Case #23-8435

On Monday July 17, 2023 at approximately 10:28 AM, Batavia Police Officers were dispatched to the 1400 block of Harvell Dr for a report of a residential burglary. Forced entry via a rear door is suspected. This burglary occurred between approximately 10:30 AM on Saturday July 15, 2023 to the time it was reported.

On Sunday July 16, 2023, a citizen on the same street reported suspicious circumstances involving subjects walking through their yard the previous evening (Saturday) in the overnight hours. Police are reviewing surveillance video.

No one was home at the time of this burglary. The victims reported missing miscellaneous jewelry and money. The investigation is on-going and there are no criminal charges at this time. Residents in the area are asked to check any exterior surveillance footage around the time of this incident.

On Monday, July 24, 2023, Batavia Police placed Ronda V. Wilson, 41, of the 1000 block of Garfield Blvd in Chicago, IL, into custody on an arrest warrant in connection with these burglaries. She was subsequently transported to the Kane County Jail for a bond hearing. Following consultation with the Kane County States’s Attorney’s Office, Wilson was charged with the following:

Residential Burglary – 720 ILCS 5/19-3(a) – Class 1 felony (2 counts)

Burglary – 720 ILCS 5/13-1(a) – Class 2 Felony (1 count)

Unlawful Use of Credit Card – 720 ILCS 5/17-36 – Class 4 Felony (8 counts)

The charges against Wilson are not proof of guilt. Wilson is presumed innocent and is entitled to a fair trial in which it is the State’s burden to prove guilt beyond a reasonable doubt.

Thursday, June 22 2023

On Wednesday, June 21, 2023, the Batavia Police Department took two reports of residential burglaries to apartments in a retirement community located in the 2400 block of Hawks Dr. The burglaries occurred between 10:00 PM and midnight on Monday, June 19, 2023. The facility provided surveillance video depicting an African American female wearing a black top and black pants who had gained unauthorized access to at least two units in the building. It is believed that the suspect entered one unit while the resident was sleeping and stole her purse. The other unit was vacant, and nothing is believed to have been taken. There were no signs of forced entry to either apartment, however, it is believed the suspect did force entry into an office in the building, causing minor damage. Police are releasing two surveillance images of the suspect. Anyone knowing the identity of the pictured subject or with information about this case is asked to call the Batavia Police Department at 630-454-2500.

Vehicle Burglaries / Crime Prevention Alert

Between June 18, 2023, and June 20, 2023, the Batavia Police Department received several reports of burglaries to unlocked motor vehicles occurring in the early morning hours. These incidents occurred in both the northwestern and the southeastern residential areas of Batavia. Specifically, the 1900 and 2000 block of Wagner Road (southeast) and the 0-99 and 100 block of N. Barton Trail and 2800 block of Weaver Lane (northwest) were targeted. The Batavia Police Department is currently reviewing a number of leads reference these cases. Citizens are strongly encouraged to keep their vehicles locked at all times. In addition, please remove all valuables from your vehicle, including car and house keys and garage door openers. Suspects involved in these burglaries are known to utilize garage door openers to enter victim’s garages and residences, though there is no indication that occurred during these incidents. Please call 911 immediately to report any suspicious activity that you may see in your neighborhood. Additionally, residents in the area with surveillance or doorbell cameras are asked to check their camera footage for suspicious activity. Based on evidence from these cases, the burglaries most likely occurred during the overnight hours. Case # 23-06255

The Batavia Police Department is investigating a traffic crash that occurred on Wednesday, May 31, 2023, at 2:29 PM on S. Batavia Avenue at the intersection of Union Avenue. A preliminary investigation revealed that a newer model GMC Denali was southbound on S. Batavia Avenue when it struck a bicyclist in the intersection. The bicyclist was westbound Union Avenue within the crosswalk riding across S. Batavia Avenue. Batavia Avenue was shut down to vehicular traffic between Morton Street and Main Street for the ensuing investigation.

The occupant inside of the vehicle was not injured during the incident. The bicyclist, a teenage boy, sustained critical injuries and was transported to an area hospital for medical care.

No additional information related to the crash investigation is being released at this time as the investigation is in progress. The Batavia Police Department is being assisted in this investigation by the Kane County Accident Reconstruction Team.

Case # 23-05913

UPDATE: After a review of all the known facts, statements of involved parties and independent witness statements, there will be no citations or charges issued to the driver of the minivan in this incident. Statements indicate that the minivan had no opportunity to avoid colliding with the bicyclist as the rider entered the intersection. There are no indications that speed played a factor in this incident.

The Batavia Police Department is investigating a traffic crash that occurred on Tuesday, May 23, 2023, at 4:42 PM on S. Batavia Avenue at the intersection of Millview Drive. Preliminary investigation revealed that there was a newer model Honda minivan northbound on S. Batavia Avenue when it struck a bicyclist in the intersection. The bicyclist was westbound exiting Les Arends Forest Preserve crossing S. Batavia Avenue towards Millview Drive. Batavia Avenue was shut down to vehicular traffic between Mooseheart Road and Sycamore Lane for on-site investigation.

None of the occupants inside of the minivan were injured during the incident. The bicyclist sustained critical injuries and was transported via life flight helicopter to Good Samaritan Hospital in Downers Grove, IL.

No additional information related to the crash investigation is being released at this time as the investigation is ongoing. The Batavia Police Department is being assisted in this investigation by the Kane County Accident Reconstruction Team.

Wednesday, May 24, 2023

Case # 23-05947

The Batavia Police Department responded to a traffic crash that occurred Wednesday, May 24, 2023, at 11:34 AM on S. Batavia Avenue at the intersection of Merlo Street. Investigation revealed that the driver of a 2013 Lexus ES250 passenger vehicle was in the process of turning from westbound Merlo Street onto southbound S. Batavia Avenue. At the same time there was a 2022 Freightliner Truck that was southbound on S. Batavia Avenue passing through the intersection of Merlo Street. The driver of the Lexus passenger vehicle failed to yield and drove directly into the side of the Freightliner Truck.

As a result of the crash, the driver of the Lexus passenger vehicle was trapped inside the driver’s compartment. Batavia Fire Department personnel were able to extricate the driver and transport him to an area hospital with non-life-threatening injuries. The driver of the Freightliner Truck was not injured. Evidence collected from the crash indicates that the Freightliner Truck was traveling 5 MPH under the posted speed limit at the time of the crash. Batavia Avenue was shut down to vehicular traffic in both directions between Carlisle Road and Morton Street for approximately 2 hours while the investigation and clean up ensued.

The driver of the passenger vehicle was identified as Christopher L. Tondola (65 YOA) of North Aurora, IL. Tondola was issued a citation for failure to yield at intersection (625 ILCS 5/11-901). Any further media inquiries should be directed to Chief Shawn Mazza.

POLICE ANNOUNCE DUI ARREST RELATED TO FATAL TRAFFIC CRASH

On Sunday, May 7, 2023, at 5:12 PM, officers were dispatched to a report of a traffic crash involving a motorcycle and a Chevrolet van in the 400 block of S. River Street. The initial investigation indicates that the motorcycle was southbound in the 400 block of S. River Street when it was struck from behind by a Chevrolet van that was also southbound. The rider of the motorcycle was ejected, and the motorcycle remained pinned underneath the van. The driver of the van subsequently pulled over to the side of the road. The rider of the motorcycle was critically injured and was transported from the scene to a nearby hospital where he succumbed to his injuries. The name of the deceased motorcyclist is not being released at this time, pending notification of next of kin.

After investigation at the scene, the other involved driver was subsequently placed into custody for DUI. Investigators conferred with the Kane County States’ Attorney’s Office, and criminal charges against the defendant were authorized.

In addition to medications, the Batavia Police Department will collect vape pens or other e-cigarette devices from individual consumers only after the batteries are removed from the devices. It is important to stress that the Batavia Police Department is not responsible for removing the batteries from the devices.

If the batteries cannot be removed, individual consumers can check with large electronic chain stores who may accept vape pen or e-cigarette devices for proper disposal.

Individual consumers may also contact their local Hazardous Materials Management Facility to determine if they accept these devices, and for additional guidance regarding proper disposal.

POLICE MAKE ARREST IN HIT-AND-RUN CRASH

Saturday, April 1, 2023, at approximately 2:40 AM, officers were dispatched to the intersection of Walnut Street and S. Batavia Avenue for a report of a hit-and-run traffic crash that occurred near that intersection. That area of S. Batavia Avenue had been closed for several hours by the City of Batavia Emergency Services and Disaster Agency (ESDA) due to ongoing electric utility repairs to damaged poles and electrical lines that had been damaged by severe weather. ESDA personnel utilized traffic cones, barricades, flares, and a marked ESDA vehicle with overhead lights operating to close the road to approaching N/B traffic.

Investigating officers were informed that a vehicle traveling N/B on S. Batavia Avenue failed to stop for the road closure, striking a roadway barricade and the ESDA vehicle just north of Walnut Street. After the crash, the offending vehicle continued N/B through the area of the closure, and then exited the closed area traveling E/B on Main Street from S. Batavia Avenue. The vehicle and driver were located by responding officers in a nearby business parking lot in the 200 block of Pamarco Drive. The vehicle, a blue, 2019 Hyundai Sonata, had damage consistent with being involved in the aforementioned crash. The City of Batavia ESDA vehicle sustained moderate damage to the rear driver side quarter panel of the vehicle and the Hyundai Sonata had damage to the driver side front bumper and front quarter panel area. The driver of the Sonata did not report any injuries and the ESDA vehicle was parked and unoccupied at the time of the crash.

Officers began investigating the crash and identified the driver of the Sonata as 29-year-old Jennifer Carrasco of the 900 block of Lois Lane, Joliet, Illinois. After investigation, Carrasco was arrested and the following charges were filed with the Kane County State’s Attorney’s Office:

• Driving Under the Influence - 625 ILCS 5.0/11-501(a)(2) – Class A Misdemeanor

• Driving Under the Influence - 625 ILCS 5.0/11-501(a)(1) – Class A Misdemeanor

• Leaving Scene of a Property Damage Accident - 625 ILCS 5.0/11-402 – Class A Misdemeanor

• Failure to Reduce Speed to Avoid an Accident – 625 ILCS 5.0/11-601(a) – Petty offense

The charges against Carrasco are not proof of guilt. Carrasco is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.

BATAVIA POLICE SERGEANT AWARDED PRESTIGIOUS SCHOLARSHIP

Batavia Police Department Sergeant Chris Potthoff is the recipient of the 2023 Carl Dobbs Memorial Scholarship Award – an award given annually by the Illinois Chiefs of Police Association.

“The Batavia Police Department is grateful to have outstanding people within the organization and Sergeant Potthoff exemplifies the characteristics of what our leadership team looks like. Thank you to the Illinois Chiefs of Police Association and the family of Chief Carl Dobbs for providing this amazing opportunity,” said Batavia Chief Shawn Mazza.

The Carl Dobbs Memorial Scholarship is dedicated to the enhancement of the law enforcement profession within the State of Illinois by providing management training to interested and qualified police departments and their personnel. The scholarship will cover the cost of tuition for a full-time, active police officer of the rank of sergeant or above to attend one of the 10-week offerings of the School of Police Staff and Command of Northwestern University’s Center for Public Safety.

The scholarship was created to honor the memory of Carl Dobbs, who died in 2008. Dobbs was the Chief of Police of Wheaton, Illinois, the Interim Police Chief of Northlake, Bensenville, Roselle, Forest Park and Berwyn, and the past president of the Illinois Association of Chiefs of Police. The scholarship is made possible through the generosity of the Dobb family and his friends, as well as Northwestern University’s Center for Public Safety.

Potthoff is the fifth recipient from the Batavia Police Department to earn the scholarship.

“Sergeant Potthoff continues the tradition of excellence that our citizens have come to expect from our police department. We congratulate him for earning this scholarship, and wish him continued success as he attends classes at Northwestern,” said Batavia Mayor Jeff Schielke.

BATAVIA POLICE INVESTIGATE RESIDENTIAL RUSE BURGLARY

On Tuesday, April 4, 2023, at approximately 9:00 AM, Batavia Police responded to a report of lost property and missing jewelry in the 300 block of Blair Street. Through the course of the investigation, the patrol officer determined the complainant had likely been the victim of a ruse burglary the previous week. The victim reported that during the day sometime between March 27, 2023 and March 30, 2023, he had been approached at his home by an individual who identified themselves as an employee of the City of Batavia Electrical Department. The individual advised the victim there was an issue and guided him to the backyard of the residence. A short time later, the individual received a phone call, telling the victim they would be back shortly and never returned. The Police Department has confirmed there were no Electric Department employees at the victim’s home during those dates.

Residents are reminded that all City of Batavia employees and employees of any public utility will have their official identification with them. If an individual represents themselves as working for the City of Batavia or any public utility entity, and the situation is in doubt, citizens should call the appropriate department or the Batavia Police Department to confirm the circumstances are legitimate. Criminals who perpetrate ruse burglaries will often distract their victims, allowing another individual to enter the residence undetected and steal the victim’s property. These burglaries can occur in a matter of minutes, and most often target the community’s older population.

BATAVIA POLICE INVESTIGATE CAR BURGLARIES AND STOLEN VEHICLE

On Tuesday, April 4, 2023, at approximately 5:43 AM, Batavia Police responded to a report of individuals committing burglaries to motor vehicles in the 600 block of Brady Way. Police checked the area but were unable to locate any suspects. Police subsequently located and recovered an unoccupied KIA sedan in the 500 block of Alberosky Way that was reported stolen by Chicago PD. Later in the morning, a citizen reported the theft of a white Jeep SUV from the driveway of a residence in the 700 block of Lusted Lane. Police responded to two additional burglary to motor vehicle reports in the 2300 block of Bird Lane.

All of these incidents occurred in the Tanglewood subdivision are likely connected. There is no evidence of forced entry to the vehicles that were burglarized. Batavia Police are actively developing and following up on leads and working with other law enforcement agencies. Video surveillance provided by residents indicated there were several individuals committing these burglaries. The suspects are believed to have arrived in the neighborhood in a white SUV, and black SUV, and the recovered Kia sedan.

BATAVIA POLICE MAKE ARREST IN INDECENT EXPOSURE INVESTIGATION

Batavia Police investigated a report of indecent exposure that allegedly occurred on Sunday, April 2, 2023, at approximately 4:30 PM, at H.C. Storm School located at 305 N. Van Nortwick Avenue. A citizen reported that his pre-teen daughter, along with another female pre-teen, encountered an adult male near the playground area of the school; the male subject allegedly exposed himself to the girls. This incident was reported to police approximately 30 minutes after the time of occurrence. Patrol officers went the area where the incident occurred, but were unable to locate the adult male. The adult male was last seen riding his bicycle southbound on N. Van Nortwick Avenue. Batavia Police were subsequently able to obtain video surveillance footage depicting the incident.

On Monday, April 3, 2023, a Batavia Police officer located an individual matching the description provided by the teen girls. The individual was taken into custody and transported to the Batavia Police Department for further investigation. After consulting with the Kane County State’s Attorney’s Office, the individual was subsequently charged with multiple criminal offenses.

BATAVIA POLICE RESPOND TO COMMERCIAL BURGLARIES

On Wednesday, March 1, 2023, at approximately 2:25 AM, officers were patrolling the area of the Randall Road retail corridor in Batavia after receiving information that neighboring jurisdictions had numerous reports of commercial burglaries. An officer observed a vehicle, subsequently determined to be a stolen Kia sedan, leaving the area of Mill Street and Randall Road at a high rate of speed. The officer, along with law enforcement from other agencies, pursued the vehicle, but subsequently terminated the pursuit for safety reasons after vehicle speeds became unreasonable and the occupants of the vehicle began throwing items out of the vehicle. The vehicle and its occupants have not yet been located.

Batavia officers began checking the commercial establishments on Randall Road for signs of criminal activity. Officers subsequently discovered two businesses in the 1800 block of Mill Street that had damage to their glass front doors, with one of them completely shattered. Representatives from the businesses were contacted and responded to the scene. It is unknown at this time if any items were stolen from the businesses. Batavia PD investigators, along with investigators from several other law enforcement agencies are actively following up leads.

BATAVIA POLICE OFFICER MICHAEL WALTERS EARNS KANE COUNTY OFFICER OF THE YEAR LOUIS SPUHLER AWARD

The Kane County Chiefs of Police Association, in partnership with the Batavia Moose Lodge #682, announced Batavia Police Officer Michael Walters is the winner of the Louis Spuhler Award for outstanding police work in 2022. The award was announced at the 46th Annual Kane County of the Year Banquet Feb. 22.

In his nomination letter, Batavia Police Chief Shawn Mazza summarized the incident in which earned Officer Walter's nomination:

"On January 26, 2022, at approximately 11:11 A.M., Officer Michael Walters responded to the 200 block of South Forest Avenue in Batavia, for a domestic battery report. The victim reported that her boyfriend choked her and was threatening to kill her. Officer Walters was the first officer on the scene, and located an agitated male subject holding a three-month-old baby. The subject, whose hands were scraped and bloodied, would not follow commands from officers to relinquish the child to the mother. Officer Walters assessed the situation and kept close enough to rescue the infant, but far enough away as to not escalate the situation and cause the subject to harm the baby. Officers later learned that prior to their arrival, the male subject forcibly removed the baby from the baby’s mother, then choked the mother three separate times, causing the mother to lose consciousness at one point.

The male subject remained very agitated throughout the incident and continually threatened to harm the baby. He stated several times that he would make the officers on scene shoot him. Officer Walters kept a dialogue with the subject and built a rapport with him. The subject eventually agreed to speak with counselors by phone. Officer Walters remained calm and persistent in the pursuit of trying to verbally de-escalate the situation for over 74 minutes. Thankfully, the subject was convinced to release the baby to a relative.

The offender was taken into custody and charged with two felonies and multiple misdemeanor counts of domestic battery, obstructing a peace officer, and endangering the life of a child. Officer Walters displayed great restraint, patience, and compassion during this incident. He quickly understood that the offender was having a mental health crisis and the 3-month-old baby was at great risk of being harmed. If it were not for the actions and determination of Officer Walters, the outcome might have had grave consequences."

Dozens of officers were nominated for the award, including Batavia Officer Christopher Schultz.

MISSING PERSON - SAFELY LOCATED

On Monday, February 20, 2023, at 4:17 PM, Batavia and Geneva Police Officers were dispatched to the area of the Fox River at the Fabyan Bridge for a report of a despondent subject. Initial reports were that the person was considering jumping into the Fox River. Officers arrived and began an extensive search of the area around the bridge and Fox River Trail system. Shortly thereafter, the Batavia Fire Department, Geneva Fire Department, and St. Charles Fire Department were summoned to the Fox River where several emergency boats were launched, and a joint search of the river ensued. Ultimately the river search was fruitless and ended at nightfall.

For the next several hours, officers continued to receive information that the subject was despondent. Information obtained through cellular data led officers to search other areas around the city for the person. Other areas included the Braeburn Marsh between Western Avenue, Fabyan Parkway, and Randall Road as well as a large portion of the northwest area of Batavia and southwest portion of Geneva. The Kane County Sheriff’s Office assisted in the search using a drone. Batavia Emergency Services and Disaster Agency (ESDA) also assisted by providing artificial lighting to aid in the search efforts.

Shortly before 10:00 PM, officers made telephone contact with the subject which again led officers to search the area around the Fabyan Bridge. Using drone technology provided by the sheriff’s office, the subject was found safely laying amongst heavy brush between the westside Fox River Trail and N. Batavia Avenue just south of the Fabyan Bridge. The subject was taken by ambulance to an area hospital for medical treatment.

The joint effort of all the emergency responders involved in this incident led to the successful outcome of safely locating this individual in need of medical assistance. The Batavia Police Department would like to thank all of the agencies that assisted in the search. The agencies include the Batavia ESDA, Batavia Fire Department, Geneva Police Department, Geneva Fire Department, Kane County Sheriff’s Office, and St. Charles Fire Department.

BATAVIA POLICE DEPARTMENT ADOPTS TEN SHARED PRINCIPLES

The Batavia City Council approved a resolution for the Batavia Police Department to adopt the Ten Shared Principles -- a historic agreement between the NAACP and the Illinois Association of Chiefs of Police designed to build trust between law enforcement and communities of color.

The Ten Shared Principles are the outcome of meetings between the ILACP and the NAACP who met in 2017 to discuss common concerns, Batavia Police Chief Shawn Mazza explained to council members.

“These principles are about showing love and compassion to all people and that’s what our mission is,” said Mazza.

The Ten Shared Principles are:

We value the life of every person and consider life to be the highest value.
All persons should be treated with dignity and respect. This is another foundational value.
We reject discrimination toward any person that is based on race, ethnicity, religion, color, nationality, immigrant status, sexual orientation, gender, disability, or familial status.
We endorse the six pillars in the report of the President's Task Force on 21st Century Policing. The first pillar is to build and rebuild trust through procedural justice, transparency, accountability, and honest recognition of past and present obstacles.
We endorse the four pillars of procedural justice, which are fairness, voice (i.e., an opportunity for citizens and police to believe they are heard), transparency, and impartiality.
We endorse the values inherent in community policing, which includes community partnerships involving law enforcement, engagement of police officers with residents outside of interaction specific to enforcement of laws, and problem-solving that is collaborative, not one-sided.
We believe that developing strong ongoing relationships between law enforcement and communities of color at the leadership level and street level will be the keys to diminishing and eliminating racial tension.
We believe that law enforcement and community leaders have a mutual responsibility to encourage all citizens to gain a better understanding and knowledge of the law to assist them in their interactions with law enforcement officers.
We support diversity in police departments and in the law enforcement profession. Law enforcement and communities have a mutual responsibility and should work together to make a concerted effort to recruit diverse police departments.
We believe de-escalation training should be required to ensure the safety of community members and officers. We endorse using de-escalation tactics to reduce the potential for confrontations that endanger law enforcement officers and community members; and the principle that human life should be taken only as a last resort.

Mazza explained how the department plans to implement the principles.

“I don’t want these to be just words on paper,” Mazza said. “This needs to be rooted in the culture of our organization, and operationalizing the principles means familiarizing all of our officers with what these principles are.”

Many of the principles are already ingrained in the Batavia Police Department’s culture and interwoven into the hiring processes for officers, he added.

Mazza outlined several initiatives to engage the police department with the community in a positive way and show the human side of law enforcement. Coffee with cops, attendance at special events, more involvement in charitable events like Special Olympics fundraisers, and community partnerships through presentations on topics like fraud prevention for seniors, are some of the planned initiatives.

Additionally, Mazza said the department will continue to make training on topics such as de-escalation, crisis intervention, and use of force a high priority as the department meets and exceeds State mandates. The department will also soon begin participating in a national peer support program for officers to assist them in maintaining their overall wellbeing. Having healthy employees is key to helping officers with having positive interactions with people and with the ability to make sound decisions.

“I am pleased to see this. It speaks volumes about the police department and staff of the police department,” said Batavia Alderman Tony Malay. Batavia Mayor Jeff Schielke agreed.

“It speaks wonders on how good our police department is and how sensitive they are to the community of Batavia,” said Schielke.

CITY OF BATAVIA WARMING CENTER OPENS

The National Weather Service has issued a Wind Chill Advisory beginning 10 p.m., Feb. 2 through 10 a.m., Feb. 3. The wind chill temperature will dip to 25 degrees below zero during the 12-hour period. The cold could cause frostbite on exposed skin in as little 30 minutes. As a result, the City of Batavia has established a Temporary Warming Center Operation that will be open for the benefit of vulnerable residents.

The Warming Center will be located at Batavia City Hall, 100 N. Island Ave. While the Center will open for the 24 hours period, there are no sleeping accommodations, dedicated hygiene or washing facilities, or refrigerators for food storage. Individuals should check in at the front desk of the Batavia Police Department, the northwest entrance to the building.

Extreme cold weather conditions can be very dangerous. Especially at risk are senior citizens, infants and young children, people with disabilities, and persons taking medication for chronic health conditions. Residents who have at-risk friends, neighbors, or relatives should help by checking on them periodically. Use caution while traveling outside. Wear appropriate clothing, a hat, and gloves.

VEHICLE BURGLARIES / CRIME PREVENTION NOTICE

On January 26, 2023, the Batavia Police Department received several reports of burglaries to unlocked motor vehicles occurring in the early morning hours that day. These incidents occurred in both the northwestern and the southwestern residential areas of Batavia. Specifically, the 0-99 block of North Mallory Avenue, the 0-99 block of South Mallory Avenue, and the 200 block of Republic Road were targeted. Police were notified of delayed reports of suspicious circumstances in the nearby Stonefield Subdivision in which car alarms went off early in the morning and footprints in the snow were later located. The Batavia Police Department is currently pursuing a number of leads reference these cases. Citizens are strongly encouraged to keep their vehicles locked at all times. In addition, please remove all valuables from your vehicle, including car and house keys and garage door openers. Suspects involved in these burglaries are known to utilize garage door openers to enter victim’s garages and residences. Please call 911 immediately to report any suspicious activity that you may see in your neighborhood. Additionally, residents in the area with surveillance or doorbell cameras are asked to check their camera footage for suspicious activity. Based on evidence from these cases, the burglaries most likely occurred between 4:00 AM and 5:00 AM. TRAFFIC CRASH DUI ARREST: REPORT #22-14608

On Saturday, December 24, 2022, at approximately 5:09 PM, officers were at the intersection of W. Fabyan Parkway and Western Avenue, investigating a traffic crash that occurred at that intersection. Investigating officers utilized Batavia PD squad cars to protect the scene and alert traffic of the traffic hazard while they worked to get the involved vehicles removed from the roadway. All Batavia PD squads on scene had overhead emergency lights activated.

While investigating the crash, another vehicle traveling E/B on Fabyan Parkway failed to yield to the emergency vehicles and crashed into a marked Batavia PD squad car at a high rate of speed. The squad car had been providing crash scene protection in the aforementioned intersection. The officer was outside of the squad at the time of the crash and was narrowly missed by the offending vehicle. The vehicle, a white, 2002 Chevy Tahoe, then proceeded N/B on Western Avenue at low speeds, eventually turning down a nearby cul-de-sac before being stopped by responding officers from both the Batavia and Geneva Police Departments. The Batavia PD squad car sustained heavy damage to the rear bumper and rear hatch of the squad and the Chevy Tahoe sustained heavy front end damage.

Officers began investigating the second crash once all involved parties were accounted for and assessed for injuries. No injuries were reported as a result of the crash. The driver of the Tahoe was identified as 59-year-old Batavia resident Samuel J. Kramer of the 800 block of N. Forest Avenue. After investigation, Kramer was arrested for driving under the influence, as well as multiple additional traffic violations. The following charges were filed with the Kane County State’s Attorney’s Office:

RESIDENTIAL BURGLARY INVESTIGATED

Dec. 2, at approximately 5:15 p.m., Batavia Police Officers were dispatched to the 800 block of Gosselin Circle for a report of a residential burglary. Forced entry via a first-floor window is suspected.

No one was home at the time of this burglary, and at this time it is unknown if anything was taken. The investigation is ongoing and there are no criminal charges currently. Residents in the area are asked to check any exterior surveillance footage around the time of this incident.

PROJECT CHILDSAFE^® COMES TO BATAVIA: FIREARM SAFETY KITS TO BE DISTRIBUTED LOCALLY

BATAVIA POLICE DEPARTMENT MAKES FIREARM SAFETY KITS AVAILABLE THROUGH PARTNERSHIP WITH PROJECT CHILDSAFE

The Batavia Police Department will provide free firearm safety kits to local residents through a partnership with Project ChildSafe, the nationwide firearms safety education program. The safety kits, which include a gun lock, will be available at the Batavia Police Department’s front desk for pick up beginning Friday, December 2, 2022.

Project ChildSafe, a program developed by the National Shooting Sports Foundation (NSSF), has distributed more than 38 million firearm safety kits throughout the country since 2003. The program receives support from the firearms industry, federal and state grants and from public donations.

“We encourage residents to pick up a Project ChildSafe safety kit so that they can securely store their firearm,” said Batavia Police Chief Shawn Mazza. “Each kit contains a safety curriculum and a cable-style gun lock. The locks fit on most types of handguns, rifles and shotguns. The goal is to prevent a child or any other unauthorized person from accessing a firearm in your home.” 1.4 million homes have firearms stored in a way that makes them most accessible to about 2.6 million children according to safefirearmsstorage.org.

By partnering with Project ChildSafe, the Batavia Police Department is participating in a national effort to promote firearms safety education to all gun owners. Project ChildSafe distributes gun lock safety kits to all 50 states and the five U.S. territories. TRAFFIC CRASH -- DUI ARREST AT 800 BLOCK OF SOUTH BATAVIA AVENUE

On Saturday, November 19, 2022, at 1:58 AM officers were dispatched to a driving complaint in the 800 block of S. Batavia Avenue. While en route, officers learned that there was a 2017 Toyota RAV4 that was stopped in the lanes of traffic facing northbound on S. Batavia Avenue. Upon arrival, officers observed the vehicle was stopped with a portion of the vehicle in the northbound inside lane of traffic and a portion of the vehicle within the southbound inside lane of traffic. A Kane County Sheriff's Deputy was also on the scene investigating the complaint and assisting Batavia PD.

Officers on the scene found the vehicle to be occupied by an unconscious female subject seated in the driver’s compartment. The vehicle appeared to be in drive and the subject had her foot on the brake. Officers attempted to awaken the driver by pounding on the window. As officers were trying to enter the vehicle, the vehicle rapidly accelerated northbound where shortly thereafter it struck a marked Batavia Police vehicle with activated oscillating emergency lights. When it was struck, the police vehicle was parked and unoccupied in the southbound lanes of traffic.

The female occupant was awakened during the crash. Officers were able to enter the vehicle, put it in park and shut it off. The driver was arrested and taken to the Batavia Police Department. The information below pertains to the arrestee and charges that have been filed with the Kane County State’s Attorney’s Office.

FOX & TURKEY RUN TO IMPACT TRAFFIC ON THANKSGIVING

The 2022 Fox & Turkey Run will take place on Thanksgiving morning, Thursday, Nov. 24. There will be several temporary roadblocks and traffic interruptions throughout the northwest side of Batavia, including the intersections of Route 31 at Houston Street, McKee Street at north Van Nortwick Avenue, North Avenue at N. Van Nortwick Avenue, and North Avenue at Blackhawk Drive. There will be a full road closure on Houston Street between north Island Avenue and Route 31.

To the extent possible, this is an “open road” event whereby event participants share the roadway with the motoring public. All participants have been made aware that this is an “open road” event and have been instructed accordingly by the event organizer, Fox Valley Trail Runners.

The run officially begins at 7:30 a.m. and will end at approximately 10 a.m. The event includes a kids mile run event followed by a four‐mile family run.

The event will begin and end at the Batavia Riverwalk near the Municipal Center.

BATAVIA HIGH SCHOOL BATTERY INCIDENT

Friday, Oct. 21, at approximately 1:17 p.m., there was a disturbance in the lunchroom of Batavia High School which involved multiple students and an adult staff member. The Batavia PD School Resource Officer arrived at the scene of the disturbance shortly after it occurred, and an investigation of the incident was subsequently initiated. The investigation included interviews with numerous students and staff members, as well as a review of all relevant and available video surveillance. Both school surveillance videos and privately captured cell phone videos were furnished and reviewed by law enforcement officials. Based on the information and evidence provided, it was determined the facts of the incident are as follows:

A verbal argument ensued between a female student and other students at a lunch table. A male campus monitor observed the argument and walked over to the table to intercede. The campus monitor attempted to verbally de-escalate the situation and was ignored by the female student. The female student walked around the campus monitor and began arguing with a male student seated at the table. The female student, without physical provocation, then struck the male student about the head several times. The campus monitor, who was standing next to the female student, immediately took action to separate the female student from the male student. In doing so, the campus monitor pinned the female student against a nearby table. The campus monitor attempted to keep control of the female student while she was actively striking him and yelling at him. There was no available evidence that suggested that the holds used by the campus monitor were either intentionally or accidentally restrictive of blood flow or normal breathing ability of the student, and the student continued to strike the campus monitor while he attempted to control her. The campus monitor was eventually able to use his radio to call for help and kept control of the female student until additional staff members arrived to assist.

Upon completion of the investigation, the situation was reviewed with the Kane County States’ Attorney’s Office. It was determined that there was no probable cause to criminally charge the campus monitor.

UPDATE: INVESTIGATION ONGOING IN DOMESTIC DISTURBANCE/SUSPECT SEARCH CALL

Batavia Police were dispatched to a report of a burglary in progress in the 400 block of Mill Street, at 8:19, Oct. 27. Police were told the suspect left the area on foot. A number of police units including Batavia PD and other local Law Enforcement agencies arrived in the area to search for the suspect, who ultimately was unable to be located. As a precautionary measure, nearby schools were placed into a lockdown status which was lifted once the search for the suspect ended and it was determined there was no threat to the public.

This event was subsequently determined to be a domestic disturbance and the event was localized to one residence. This incident is currently under investigation and the Batavia Police Department will update the public when more information is available. UPDATE

Following an investigation of this incident, the suspect was identified as Miguel A. Reyes-Garcia, 33, of Aurora, IL. Reyes-Garcia is alleged to have gone to the home of the reporting victim with whom he had a previous domestic relationship. Reyes-Garcia subsequently entered the victim’s home without permission. Inside the home, the suspect allegedly battered the reporting victim, and another individual. Reyes-Garcia fled the scene prior to the arrival of law enforcement.

After consultation with the Kane County States’ Attorney’s Office, an arrest warrant was obtained for Reyes-Garcia. He was taken into custody without incident on Oct. 28 and subsequently transported to the Kane County Jail to await Bond Call before a judge. Reyes-Garcia faces the following criminal charges:

Home Invasion, 720 ILCS 5/19-6(a)(2), a Class X Felony

Criminal Trespass to Residence, 720 ILCS 5/19-4(a)(2), a Class 4 Felony

Domestic Battery-Bodily Harm, 720 ILCS 5/12-3.2(a)(1), a Class A Misdemeanor

Domestic Battery-Insulting/Provoking Physical Contact, 720 ILCS 5/12-3.2(a)(2,) Class A Misdemeanor

The charges against Reyes-Garcia are not proof of guilt. Reyes-Garcia is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.

BATAVIA POLICE INVESTIGATE RASH OF GRAFFITI INCIDENTS

BATAVIA, Sept. 26, 2022 -- The Batavia Police Department has taken numerous reports of criminal defacement, or graffiti, in the past two weeks. Citizens have reported graffiti spray painted in the downtown areas, both on the east and west sides of town. Both private businesses and public property have both been targeted during these offenses. Additionally, citizens have reported graffiti done by paint markers on signs on the Fox River Trail in town. The Batavia Police Department takes these incidents seriously and is currently investigating to identify any involved suspect(s). The Batavia Police Department requests the public’s assistance with any information that might lead to a resolution in these cases.

BATAVIA HIGH SCHOOL HOMECOMING PARADE OCCURRING WEDNESDAY, SEPTEMBER 14

Batavia High School will be holding their annual homecoming parade on Wednesday September 14, 2022. The parade will cause several temporary road closures and significant traffic delays on Wilson Street and Main Street west of State Route 31. Road closures for the parade will begin at approximately 4:40 PM. The parade route for this year is the same route as the 2021 Homecoming Parade which helped to alleviate road closures throughout downtown Batavia. Spectators are welcome to watch along sidewalks and grassy areas.

Traffic will be detoured on W. Wilson Street and on Main Street west of Route 31 (Batavia Avenue) as both W. Wilson Street and Main Street will be subject to temporary road closures. This event will have a significant impact on vehicle traffic along all roads that intersect the parade route.

Parade units will begin staging between 4:00 PM - 4:45 PM at the Batavia High School Wilson Street Lot. The parade will start promptly at 5:00 PM and proceed east on W. Wilson Street to Lincoln Street. The parade will then proceed south on Lincoln Street to Main Street. Finally, the parade will proceed west on Main Street and return back to Batavia High School at the Main Street Lot.

All vehicle traffic traveling along those roadways will be required to detour to McKee Street or Fabyan Parkway to the north or Route 56 in North Aurora to the south. Vehicle traffic needing to get to Randall Road from Downtown Batavia will be directed to McKee Street or Fabyan Parkway.

Motorists are encouraged to plan their route accordingly during this timeframe to avoid the parade route and minimize travel delays. The parade is expected to last approximately one hour, with all roads open by 6:15 PM.

THE CITY OF BATAVIA VETERAN OFFICER NEW POLICE CHIEF

Batavia Mayor Jeff Schielke delivered the oath of office to Shawn Mazza as the new Chief of the Batavia Police Department. Mazza replaces Chief Dan Eul who is retiring effective Sept. 12.

Mazza is a 23-year veteran of the Batavia Police Department and has served various roles during his tenure including patrol officer, field training officer, patrol officer-in-charge, detective, detective sergeant, and deputy chief. He previously served as a member of the Kane County Major Crimes Task Force and has been active as a volunteer with Special Olympics Illinois throughout his career.

“The City is fortunate to have Chief Mazza in this critical role. He is a dedicated leader who has made public safety of the citizens of Batavia and the men and women of the Batavia Police Department his top priority,” said Batavia City Administrator Laura Newman. “His extensive experience in both administrative and patrol roles, and his demonstrated commitment to our community, will ensure the Batavia Police Department is well-positioned for the future.”

Mazza has been an award-winning officer for Batavia since arriving in 1999. He was the Officer of the Year in 2001 and was awarded the Loyalty, Service, and Commitment to Department & Community Award in 2007 and 2009. In 2012 he was nominated for the Louis Spuhler Kane County Officer of the Year Award and ultimately awarded the department’s Life Saving Medal for actions taken to save the life of a person threatening suicide.

“I feel a great sense of pride in being named Batavia Police Chief. I am extremely fortunate to have gained knowledge and skills in my work within this organization, and I hope to continue to be an agent for positive change in this community,” Mazza said.

As Batavia’s police chief, Mazza will oversee a department of over 50 staff members and a $7 million budget.

“Batavia has an outstanding and dedicated team of officers and civilian employees who have a passion for serving and protecting the citizens of this community,” Mazza said. “I am proud to be part of this team.”

Born and raised in Naperville, Mazza holds a bachelor of science degree from Arizona State University in Justice Studies and is a graduate of Northwestern University School of Police Staff and Command.

BATAVIA POLICE CHIEF DAN EUL ANNOUNCES RETIREMENT

After 26 years of service, Batavia Police Chief Dan Eul will retire effective Sept. 12. Shawn Mazza was named Batavia Police Chief at the Sept. 6 Batavia City Council meeting.

Eul joined the Batavia Police Department in 1996 as a patrol officer, and then moved up through the organization as a sergeant and deputy chief before being named chief in 2017.

Throughout his career, Eul has been recognized for outstanding service to the community. He received the Officer of the Year Award in 2000, the Medal of Valor in 2008, and in 2013 the Fredrick G. Behner III Award for his demonstration of loyalty, service, and commitment to the department and the community.

During his career, Eul also served as a Deputy Chief where he helped to shape policy and move the department forward through the implementation of innovative practices and new technologies.

“During his years as Chief, the department faced the most serious threats to public safety perhaps in the City’s entire history,” said Batavia City Administrator Laura Newman. “In every case, whether it was civil unrest, threats posed by armed individuals, or a global pandemic, Chief Eul called upon his experience, knowledge, and ability to lead in developing plans and countermeasures to ensure that citizens of Batavia were protected.”

In addition to his service to Batavia, Eul has served our country as a sergeant in the United States Marine Corps from 1991-1997. He was called to service again, being deployed to Iraq with the U.S. Army Reserve/Illinois National Guard where he held the rank 1st lieutenant – infantry. In total, Eul served six years with the U.S. Army Reserve from 2003 – 2009 and was recognized for his service to our country as the recipient of the Batavia PD Patriot Award in 2009.

“Chief Eul has succeeded in enhancing the already high regard the community has for its police force. While we are certainly going to miss him as he begins a new chapter in his life, we will always be eternally grateful for his leadership in accepting the tremendous responsibility that it was to be Batavia’s Police Chief these last five years,” said Batavia Mayor Jeff Schielke.
